The property offered in this sale will be offered and sold by the Illinois Chapter of the Juvenile Diabetes Research Foundation (JDRF). Any questions should be directed to JDRF and not to Stokes Auction Group, which serves merely as auctioneer for JDRF in conducting the auction sales and participates on the following terms and conditions, as amended by any posted notices or oral announcements during the sale, which govern the sale of all the property offered at the auction:
JDRF and its Illinois Chapter assume no responsibility for the authenticity, condition or validity of the description of the items offered. Retail values are established by the donor, and in some cases, are estimates of the value. All property is sold as is, and buyers must realize that the restrictions noted are non-negotiable. By purchasing items, buyers waive any claims for liability against JDRF and its Illinois Chapter. The donor shall not be responsible for any injuries, damages or other liability claims, which may result from the use of the items sold. Prizes redeemed are non-transferable (including, but not limited to, the offering of prizeletter(s) on public auction websites such as eBay).
No statement in any catalogue, notice or description made at the sale, in any bill of sale invoice or elsewhere, shall be deemed such a representation or warranty or any assumption of liability, nor be deemed to have made any representations or warranty of physical condition, size, quality, rarity, genuineness, authenticity, or historical relevance. Neither the Stokes Auction Group nor JDRF makes any representation or warranty, expressed or implied, as to whether the purchaser acquires any reproduction rights in the property.
The Stokes Auction Group and JDRF reserve the right to reject a bid from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneer and/or a JDRF Auction Committee official shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, JDRFs sale records shall be conclusive in all respects.
When the auctioneer announces that an item is sold during the Live Auction, the highest bidder shall be deemed to have purchased the offered lot subject to all the conditions set forth herein and thereupon assumes the risk and responsibility thereof, will sign a confirmation of purchase thereof and will pay the full purchase price thereof or such part as JDRF may require.
Silent Auction
The Silent Auction begins at 5:30 p.m. and closes at 7:20 p.m. All items in the auction have bid sheets. Bidders must print their name, telephone number, and bid number next to the pre-printed bid amount they select. Each increase in bid must equal or exceed the minimum increase amount stated at the top of the bid sheet to constitute a valid bid. All bid increases must be in full dollar amounts. If there is no bid number listed next to the name, a bid will be disqualified.
The Silent Auction tables will close at 7:20 p.m. and will be clearly announced in the auction area. No bidding will be allowed after the sections are closed. The closing valid bid circled by the auction official constitutes the winning bid. In the event of a dispute, an Auction Committee official shall act as the final authority and shall determine the winning bidder. The officials decision will be final.
Winning bidders will be posted in the lobby after dinner. To claim a prize, winners must identify themselves at the Payment Center (or Item Pick Up if they participated in Express Check Out) with their bid number and name. Once payment has been made, bidders will proceed to Item Pick Up to claim prizes. Auction cashiers will be available from 9:30 p.m. until midnight.
Payment and Pick-Up
Payment for prizes may be made by cash, check, Discover, MasterCard, Visa, or American Express and must be made on the night of the event or the item will be offered to the next highest bidder. Any checks should be payable to the Juvenile Diabetes Research Foundation.
All sales are final. The donor value refers to each individual item. Multiple items are available only when indicated.
Please note for federal income tax purposes, your tax-deductible amount is limited to the excess contribution paid above the fair market value.
All property shall be removed from McCormick Place/Arie Crown Theater by the purchaser, the night of the event or arranged for pick-up from JDRF at 500 North Dearborn, Suite 305, Chicago, Illinois, 60654 at the purchasers expense. Shipping can also be arranged at the bidders expense. Deliveries will be arranged for a mutually agreed upon date and time during the week of December 14-18, 2009. Items not picked up by January 8, 2010 will be sold to the next highest bidder.
If the purchaser cannot comply with the foregoing conditions and other applicable conditions, in addition to other remedies available to JDRF by law, including, without limitation, the right to hold the purchaser liable for the bid price, JDRF, at its option, may either cancel the sale or resell the property on three days notice to the purchaser, and for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for payment of any deficiency, all other charges due hereunder and incidental damages.
Guaranteed Winning Bid
No more standing in line or hovering over the auction items you desperately want. You can bypass a bidding war if you are willing to pay top dollar for an item! Its that easy!
Heres how it works: all items in the Silent Auction are open to bidding. Each item, however, will also list a Guaranteed Winning Bid that is set above the value of the item. Guaranteed Winning Bids may be made at any time prior to the time of a sections closing. A Guaranteed Winning Bid ends all bidding and guarantees the sale of that item to the Guaranteed bidder. If no one chooses to be the Guaranteed Purchaser, the last highest valid bid at the closing will be the successful bidder.
